Former NIAID Adviser David Morens Indicted for Concealing COVID Records

A federal grand jury in the District of Maryland returned an indictment on April 28, 2026, charging David M. Morens, 78, a former senior adviser to Dr. Anthony Fauci at the National Institute of Allergy and Infectious Diseases, with conspiracy against the United States, destruction and falsification of records in a federal investigation, unlawful concealment and removal of federal records, and aiding and abetting [1]. Prosecutors allege Morens and unnamed co-conspirators deliberately routed official government communications through his personal Gmail account to shield those records from Freedom of Information Act requests [1][2]. The indictment marks the first criminal prosecution of a senior federal health official for alleged misconduct during the COVID-19 pandemic [2].

The records at issue relate to COVID-19 research grants administered through NIAID, including a bat coronavirus grant that funded the Wuhan Institute of Virology via EcoHealth Alliance, a grant NIH later terminated [2]. Federal law requires that agency records, including those in unofficial accounts when used for official business, remain subject to FOIA disclosure obligations. Prosecutors contend Morens understood that obligation and took affirmative steps to circumvent it, including coordinating with others to keep responsive materials out of official channels [1]. The FBI and the Department of Health and Human Services Office of Inspector General jointly investigated the case [1].

The case was filed in the U.S. District Court for the District of Maryland, based in Baltimore [1]. Deputy Attorney General Todd Blanche was identified in connection with the announcement, underscoring the Justice Department's framing of the prosecution as a priority accountability matter [1]. Morens retired from NIAID before the indictment was returned. Dr. Fauci, who led NIAID for decades before retiring in December 2022, has not been charged and is named in the indictment only in his capacity as Morens's former supervisor [2].

If convicted on all counts, Morens faces substantial federal prison exposure under the relevant obstruction and records statutes. The case is expected to draw renewed congressional scrutiny of NIAID's FOIA compliance practices and the broader handling of pandemic-era communications by federal health agencies [2].
