DOJ Pays $1.25 Million to Settle Michael Flynn Malicious Prosecution Suit

The U.S. Department of Justice agreed to pay $1.25 million to former National Security Adviser Michael Flynn to settle a civil lawsuit Flynn filed in 2023 alleging malicious prosecution by federal agents [1][2]. The settlement resolves claims that the government wrongfully prosecuted Flynn for making false statements to FBI agents during a January 2017 interview at the White House [2]. Flynn had sought $50 million in damages [1].

Flynn pleaded guilty twice to lying to FBI agents before the Trump DOJ moved in 2020 to drop the charges, a decision a federal district court resisted before an appeals court ultimately compelled dismissal. Flynn received a full presidential pardon from President Trump in November 2020. His 2023 civil complaint, filed in the Southern District of Florida, alleged that prosecutors and investigators acted without probable cause and with improper motive, bringing claims cognizable under federal tort law and Bivens doctrine [1][2]. The current DOJ characterized the original prosecution as an "historic injustice," framing the settlement as corrective rather than merely a civil resolution [1]. The $1.25 million figure represents a fraction of Flynn's $50 million demand but constitutes a direct Treasury payment to a figure whose prosecution the sitting administration has formally repudiated [2]. A separate Flynn action pending in the U.S. Court of Federal Claims was not included in this settlement and remains active [1].

The settlement requires no admission of liability by the government, a standard feature of civil resolutions but one that forecloses any judicial finding on whether the original prosecution was in fact improper [1]. Critics have noted the precedent of a presidential administration paying a political ally over law-enforcement conduct the same administration directed, without independent adjudication of the underlying facts. No congressional oversight action has been announced in connection with the settlement as of publication.
