CIA Whistleblower Alleges Agency Obstructed DNI COVID Origins Review

A senior CIA operations officer testified publicly before the Senate Homeland Security and Governmental Affairs Committee on May 13, 2026, accusing the agency of obstructing a congressionally relevant review of its COVID-19 origins assessments and illegally surveilling personnel assigned to conduct that review. James E. Erdman III, identified as a senior operations officer, testified before the committee, which was examining claims that intelligence officials downplayed the possibility that COVID-19 emerged from a laboratory. The committee had subpoenaed Erdman's testimony and had previously interviewed him in a classified setting. The hearing was called by committee Chairman Sen. Rand Paul, R-Ky., who has led congressional COVID origins oversight for several years. Sen. Ron Johnson, R-Wis., also participated.

Erdman's testimony centered on his work as a member of the Director's Initiatives Group, or DIG, a task force established by Director of National Intelligence Tulsi Gabbard. Gabbard announced the DIG to restore transparency and accountability to the intelligence community, tasking it with investigating weaponization, rooting out politicization, exposing unauthorized disclosures of classified intelligence, and declassifying information that serves a public interest. Erdman served in the DIG from March 2025 to April 2026, reviewing the intelligence community's handling of its COVID origins probe. The DIG operated under Gabbard's authority as the statutory head of the intelligence community under the National Security Act of 1947, as amended, which vests the DNI with supervisory authority over the CIA and other member agencies. Gabbard subsequently closed the DIG, describing it as a temporary effort.

Erdman told the committee that the CIA obstructed the DIG's work through multiple means. He testified that the CIA denied the task force documents, illegally surveilled its members, and fired one of its witnesses the day after the committee interviewed that witness. More specifically, Erdman testified that the CIA illegally monitored the computer and phone usage of DIG personnel, their investigations, and their contact with whistleblowers. Erdman alleged that the CIA "illegally monitored" phones and computers of DIG personnel, characterizing those targeted as "Americans being spied upon illegally while executing duties directed by the president and under the authority of the Director of National Intelligence." On the substantive origins question, Erdman testified that CIA scientific analysts concluded multiple times between 2021 and 2023 that a laboratory leak was the most likely origin of COVID-19. He further alleged that a key CIA assessment underwent revision, with its conclusion rewritten overnight to remove a definitive finding in favor of language stating that the agency could not "precisely" determine origins, a formulation he testified deviates from standard analytic tradecraft at the CIA, which assigns confidence levels rather than claiming precision.

The CIA's response was swift and direct. CIA Director of Public Affairs Liz Lyons stated that the committee "acted in bad faith by subpoenaing an Agency officer for testimony today without notifying CIA," and characterized the witness as appearing "not as a whistleblower in pursuit of the truth, but instead in response to the subpoena." Erdman testified publicly despite fierce opposition from the CIA, which called the COVID origins hearing "political theater." Sen. Johnson publicly demanded an apology from CIA Director John Ratcliffe after reading Lyons's statement aloud during the hearing. The CIA's public posture created a procedural anomaly: the agency simultaneously argued the hearing was illegitimate while its current assessment, issued under Ratcliffe's leadership, aligns with Erdman's substantive conclusions. In January 2025, under Ratcliffe's direction, the CIA publicly assessed that a lab leak was the most likely origin point for COVID-19. Lyons noted that the CIA has provided thousands of documents in support of the committee's probe, according to POLITICO [POLITICO].

The jurisdictional friction between the CIA and the ODNI runs directly to a structural question at the heart of post-9/11 intelligence reform. Congress created the DNI position through the Intelligence Reform and Terrorism Prevention Act of 2004 to serve as the statutory coordinator and supervisor of the intelligence community, with explicit authority over the CIA. Erdman's allegations, if substantiated, would place CIA conduct in potential conflict with that statutory framework, with executive orders directing the DIG's work, and with federal surveillance law. Erdman also testified that approximately 2,000 classified documents related to COVID's origins remain under review, with Gabbard working to secure their release through the intelligence community's declassification process. Congress passed a law in 2023 mandating the declassification of COVID-related intelligence tied to the Wuhan Institute of Virology, but the Biden administration's DNI released only a limited summary. Ratcliffe himself, as former DNI, testified before Congress in 2023 that a lab leak was the only explanation credibly supported by intelligence, science, and common sense.

The hearing produces no immediate legal or administrative outcome on its own. No formal referral, resolution, or legislative vehicle was announced. However, Erdman's attorney, Carol Thompson, told reporters that her client was concerned about retaliation by the CIA. That concern sits within a well-defined statutory framework: the Intelligence Community Whistleblower Protection Act governs disclosures of classified information to Congress and provides retaliation protections, though its scope and procedural requirements differ from those of the civilian Whistleblower Protection Act. Whether Erdman's disclosures, made pursuant to a congressional subpoena rather than a voluntary complaint, satisfy the act's procedural prerequisites remains an open legal question. Following the testimony, several Republican lawmakers called for former National Institute of Allergy and Infectious Diseases Director Anthony Fauci to face criminal prosecution over the alleged suppression of COVID origins findings. The committee has not announced a prosecutorial referral.
