Ohio Jury Acquits Three Men in 2024 Akron Restaurant Shooting

A Summit County Common Pleas Court jury returned not-guilty verdicts on May 25, 2026, for all three defendants charged with murder in connection with the 2024 fatal shooting of Jamar E. Franklin [1]. The case arose from a shooting at Tasty Carry Out in Akron, Ohio, and proceeded to trial on a single charge of murder against each defendant [1]. Trial began May 11, 2026, and the jury deliberated before returning its verdict that afternoon [1].

The three defendants, Khairi Moorer, Derek Edwards, and Robert Davis, were tried together before a Summit County jury [1]. The prosecution's case centered on their alleged roles in Franklin's death at the Akron carry-out restaurant, but the jury found the evidence insufficient to sustain the murder charge against any of the three men [1]. All defendants were acquitted on all counts [1].

Because the jury returned complete acquittals on the sole charge, no sentencing proceedings are scheduled for any of the three defendants [1]. Double jeopardy principles bar the State of Ohio from re-prosecuting Moorer, Edwards, or Davis on the same murder charge arising from Franklin's death.

No post-verdict defense motions or state appellate filings have been reported [1]. The acquittals conclude the criminal proceedings against all three defendants in Summit County.
