Sean Combs Release Date Adjusted; Second Circuit Appeal Pending

The Bureau of Prisons has moved Sean "Diddy" Combs' projected release date to February 23, 2028, advancing it from an earlier estimate of April 25, 2028 [1]. Combs is currently serving a 50-month federal sentence at FCI Fort Dix in New Jersey following his conviction on transportation to engage in prostitution [1]. The adjustment reflects standard good-conduct credit calculations and does not represent a judicial or administrative ruling on the merits of his case.

The conviction arose from federal charges brought in the Southern District of New York. Combs was tried before Judge Arun Subramanian, and sentencing counsel Alexandra Shapiro filed a notice of appeal to the U.S. Court of Appeals for the Second Circuit [1]. The appeal centers on a procedurally significant question: whether the sentencing court improperly relied on acquitted conduct when calculating Combs' sentence. Federal courts have long permitted judges to consider uncharged or acquitted conduct at sentencing under a preponderance-of-the-evidence standard, a practice that has drawn increasing scrutiny from jurists and defense practitioners. The Supreme Court has declined multiple invitations to revisit the doctrine, leaving the circuit courts as the principal battleground.

The Second Circuit appeal remains pending as of mid-June 2026 [1]. A ruling in Combs' favor could require resentencing and, depending on the breadth of the opinion, could constrain how district courts within the circuit weigh acquitted conduct going forward. The case therefore carries procedural stakes that extend well beyond Combs himself.

On the civil side, Combs faces more than 70 lawsuits filed by individuals alleging a range of misconduct [1]. The most recent, filed June 9 by a former child actor, adds to a docket that has grown steadily since his arrest [1]. Those cases are proceeding on separate tracks in various courts and are not directly affected by the Bureau of Prisons' release-date calculation or the outcome of the criminal appeal.

The next significant development is the Second Circuit's ruling on the acquitted-conduct appeal. No argument date has been publicly reported. Until that decision issues, Combs' February 2028 projected release date represents the operative timeline for his incarceration.
