America First Legal’s FARA Suit Against DOJ Dismissed for Lack of Standing

A federal judge in Washington dismissed a lawsuit filed by America First Legal Foundation that sought to compel the Department of Justice to require Hunter Biden to register as a foreign agent under the Foreign Agents Registration Act [1]. U.S. District Judge Jia M. Cobb ruled that the foundation lacked Article III standing, finding it had not plausibly alleged a concrete injury [1][2]. The court further reasoned that because Biden has not registered under FARA, there is no registration record for the government to disclose, leaving the plaintiff without a cognizable claim [2].

FARA, enacted in 1938, requires persons acting as agents of foreign principals in a political or quasi-public capacity to register with the Attorney General and disclose that relationship. America First Legal Foundation argued that Biden's work for Ukrainian energy company Burisma and the China Energy Fund Committee triggered registration obligations [1][2]. The foundation sought a court order directing DOJ to enforce those obligations. Standing doctrine, however, requires a plaintiff to show an injury that is concrete, particularized, and traceable to the defendant's conduct, a threshold the court found America First Legal did not clear [2].

The ruling follows years of Republican-led scrutiny of Hunter Biden's foreign business dealings, scrutiny that produced criminal tax and firearms convictions under a separate prosecution but no FARA charges [2]. DOJ has historically been selective in FARA enforcement, bringing relatively few prosecutions even against individuals whose foreign ties have drawn congressional attention. The America First Legal Foundation, founded in 2021 and associated with former Trump administration officials, has pursued a series of administrative and judicial actions targeting Biden-era government conduct [1].

Judge Cobb's dismissal is without prejudice on the standing grounds, which leaves open, at least theoretically, the possibility of a refiled complaint if the foundation can construct a more concrete injury theory [1]. As a practical matter, Hunter Biden's legal exposure through conventional DOJ channels has diminished since his father left office and the special counsel investigation concluded. Unless a new enforcement referral or congressional action creates a fresh procedural vehicle, the FARA registration question appears resolved by default rather than by any adjudication on the merits.
