On June 3, 2024, two subsidiaries of Indiana-based research animal supplier Inotiv Inc. entered guilty pleas in federal court in connection with the operation of a now-closed beagle breeding facility in Cumberland County, Virginia. Envigo RMS LLC pleaded guilty to conspiring to knowingly violate the Animal Welfare Act, and Envigo Global Services Inc. pleaded guilty to a felony of conspiring to knowingly violate the Clean Water Act. The U.S. Attorney's Office for the Western District of Virginia announced the resolution, as NPR reported [1]. As part of the agreement, Inotiv will guarantee more than $35 million in payments, making this the largest fine ever imposed in an Animal Welfare Act case. [2][3]
According to court documents, Envigo RMS conspired to knowingly violate the Animal Welfare Act by failing to provide, among other things, adequate veterinary care, adequate staffing, and safe living conditions for dogs housed at the Cumberland County facility. [3] Members of Envigo's leadership team knew since at least July 2021 that the Virginia facility was operating in violation of the Animal Welfare Act. [4] Between 2019 and May 2022, Envigo sold nearly 15,000 dogs from the facility for a profit of around $16 million. [4] Meanwhile, the on-site wastewater treatment plant discharged more than 600,000 gallons of wastewater that failed to comply with permit limits into Maxey Mill Creek. [4]
The investigation originated from USDA inspections and a 2021 undercover probe. The Justice Department's criminal and civil investigations into Envigo began after U.S. Department of Agriculture Animal and Plant Health Inspection Service inspectors documented more than 60 violations of animal welfare laws between July 2021 and March 2022 at the Class A dog breeding facility in Virginia. [5] The resulting overcrowding, filth, untreated disease, and hundreds of unexplained puppy deaths generated national headlines and a high-profile rescue operation in summer 2022, when the Justice Department seized 4,000 dogs that were eventually adopted. [2] Nearly 450 beagles were found in acute distress when officials arrived. [4]
The financial terms of the plea agreement are structured across multiple obligations. Inotiv agreed to pay $22 million in criminal fines, representing $11 million per violation, plus an additional $13.5 million to support animal welfare and environmental projects, cover law enforcement expenses, and improve its own facilities. [5] The fines include $1.1 million to the Virginia Animal Fighting Task Force, $1.9 million to the Humane Society of the United States, and $3.5 million to the National Fish and Wildlife Foundation to restore ecosystems in Cumberland County. [4] The entities will serve probation from three to five years and must spend at least $7 million to improve their facilities and personnel beyond the standards imposed by the Animal Welfare Act. [4] The plea agreement also bans the company from breeding or selling dogs. [4]
U.S. Attorney Christopher R. Kavanaugh for the Western District of Virginia stated that "Envigo promoted a business culture that prioritized profit and convenience over following the law," and that the approach "led to dire consequences: the inhumane treatment of animals and the contamination of our waterway." [3] The entities will pay for a monitor to oversee compliance with the animal welfare standards outlined in the agreement, and sentencing was scheduled for Oct. 7. [4]
